SP000-001  PDF  RTF  Nondiscrimination - Provides for the inclusion of nondiscrimination clauses into every contract subject to Title VI of the Civil Rights Act of 1964. (2014 SP 000-002) Statewide Use.
SP000-002  PDF  RTF  Certification of Nondiscrimination in Employment - Add certification of having had a previous contract or subcontract subject to the equal opportunity clause required by the Equal Employment Opportunity Regulations of the Secretary of Labor. (2014 SP 000-003) Required on Federal-Aid Construction projects. Statewide Use.
SP000-004  PDF  RTF  On-the-Job Training Program - Revises the process by which training assignments are based. (2014 SP 000-006). Required on all federal-aid construction projects. Statewide Use.
SP000-007  PDF  RTF  Cargo Preference Act Requirements in Federal Aid Contracts - Notification of the requirement to comply with the U.S. Department of Transportation's (DOT) Cargo Preference Act Requirements, 46 CFR Part 381, Use of United States-Flag Vessels. (2014 SP 000-241) Required beginning with the Statewide Use.
SP000-016  PDF  RTF  Notice of Contractor Performance Evaluations - In accordance with 43 TAC subchapter 9.26, this special provision notifies the contractor of the evaluation of contractor performance under 43 TAC subchapter 9.23. (2014 SP 000-659) Required for all low-bid projects other than MMC and TMC projects. Statewide Use.
SP000-017  PDF  RTF  Certificate of Interested Parties (Form 1295) - Revised notification, no longer required to submit a signed notarized Certificate of Interested Parties Disclosure form 1295 at contract execution, with contract amendments (COs), extensions, and renewals. (2014 SP 000-1019) Statewide Use.
SP000-022  PDF  RTF  Disadvantaged Business Enterprise in Federal-Aid - This is the 2014 DBE special provision. This is to be used for 2024 specifications until special provision reflecting the final rule is processed. Special Provision has been approved for statewide use and is required for all federal aided projects. Statewide Use.
SP000-023  PDF  RTF  Activation of Federal Contract Provisions - For insertion into all state-funded routine maintenance contracts that could potentially be used for emergency repairs related to a disaster event. Optional for state-funded routine maintenance only. NOTE: Use with RMCs that could be tied to future disasters. Statewide Use.
SP000-031  PDF  RTF  Schedule of Liquidated Damages - This updates the schedule of liquidated damages to reflect the current administrative cost. The analysis was performed by CTR with concurrence and approval form CST. Required for all 2014 and 2024 specification projects other than MMC and TMC projects starting December Letting. Replaces SP000-018 . Statewide Use.
SP006-005  PDF  RTF  CONTROL OF MATERIALS - This Special Provision is a Build America, Buy America provision relating to predominantly iron or steel products and construction materials per March 20,2025, update of 23CFR Subchapter 635.410 and 2CFR Part 184. BABA provision required on federal projects and for state funded projects cleared as a part of a corridor under a single NEPA decision with federal funding on past or future projects within that corridor. Effective 5/2025 letting. Replaces SP006-001 . Statewide Use.
SP007-001  PDF  RTF  LEGAL RELATIONS AND RESPONSIBILITIES - Replaces Article 7.20., ''Security Incidents.'' Defines notification, credential behavior, liability and prohibited technologies in regards to Cybersecurity requirements. Required for all projects beginning with the September 2025 letting. However, use of this Special Provision prior to the September 2025 letting is at the District's option. Statewide Use.
SP008-001  PDF  RTF  PROSECUTION AND PROGRESS - Supplemented sections in Article 8.6., Failure to Complete Work On Time. (2014 SP 008-045) Required when lane closure assessment fees are utilized. Statewide Use.
SP009-002  PDF  RTF  MEASUREMENT AND PAYMENT - Modifies the third paragraph of Article 9.7., ''Payment for Extra Work and Force Account Method.'' The estimated extra work limit for force accounts allowing invoice only is increased from $10,000 to $30,000. This Special Provision has been approved for statewide use and is required for all projects beginning with the September 2025 letting. However, use of this Special Provision prior to the September 2025 letting is at the District's option. Statewide Use.
SP292-001  PDF  RTF  ASPHALT TREATMENT (PLANT-MIXED) - Section 4.11.2.1., ''Operational Tolerances,'' is voided and replaced. Required for all projects using Asphalt Treatment (Plant-Mixed) beginning with the February 2025 letting. However, use of this Special Provision prior to the February 2025 letting is at the district's option. Statewide Use.
SP300-003  PDF  RTF  ASPHALTS, OILS, AND EMULSIONS - Tables 3 and 18 has been updated with specific values for polymer separation and with reference to Tex-554-C. Specification limits for cement mixing in Table 8 has been updated to reflect the values in SS 3096 (2014). Required for all projects using Asphalts, Oils, and Emulsions, beginning with the February 2025 letting. However, use of this Special Provision prior to the February 2025 letting is at the District's option. Statewide Use.
SP316-001  PDF  RTF  SEAL COAT - This Special Provision applies only to Districtwide seal coat, adds aggregate paid by the ton, and includes required Certifications for Department and Contractor personnel. Required for all projects using Seal Coat, beginning with the February 2025 letting. However, use of this Special Provision prior to the February 2025 letting is at the District's option. Statewide Use.
SP500-001  PDF  RTF  MOBILIZATION - This Special Provision adds incremental mobilization payments for when 2%, 6%, and 8% of the adjusted Contract amount for construction items is earned. Required for all projects $150 million or greater using ''Mobilization'' beginning with the September 2025 letting. However, use of this Special Provision prior to the September 2025 letting is at the district's option. Statewide Use.
SP672-001  PDF  RTF  RAISED PAVEMENT MARKERS - Outlines the use and installation of Raised Pavement Markers (RPMs) in recessed grooves in pavement for areas where snowplows or similar equipment are regularly used, and minimizing the loss of RPMs is desired. Required for all projects using ''Raised Pavement Markers'' beginning with the September 2025 letting. However, use of this Special Provision prior to the September 2025 letting is at the district's option. Use in place of SS 6020. Statewide Use.
